These Terms of Service ("Terms") govern your access to and use of the MusicPulse web application and browser extension (the "Service"), provided by MusicPulse ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Description of Service
MusicPulse provides a music identification tool that analyzes social video signals to identify songs, remixes, and edits from YouTube, TikTok, Instagram Reels, and other supported social video pages. The Service may include audio recognition, lyrics and hook search, platform-specific clues, multi-platform link generation, and waitlist registration.
2. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.
3. Acceptable Use
You agree not to:
- Use the Service to infringe any intellectual property rights or privacy rights of third parties.
- Attempt to reverse-engineer, decompile, or extract the source code of the Service.
- Use the Service for any illegal purpose or in violation of any applicable laws or platform terms, including YouTube, TikTok, Instagram, and Google's API Services User Data Policy where applicable.
- Scrape, harvest, or collect data from the Service in bulk.
- Resell, redistribute, or sublicense the Service without our express written permission.
4. Intellectual Property
The Service and its original content, features, and functionality are owned by MusicPulse and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Song titles, artist names, and links generated by the Service are sourced from public data and are not claimed as our intellectual property.
5. Third-Party Links and Services
The Service may display links to third-party websites (e.g., Spotify, SoundCloud, YouTube Music). We have no control over the content of these sites and accept no responsibility for them. Your use of third-party services is at your own risk.
6. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will accurately identify every song or remix. Audio identification results may be incorrect, incomplete, or unavailable.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MUSICPULSE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
8. License and Paid Plans
MusicPulse offers a Lifetime License at a one-time purchase price. The current plan includes access while the product is available, up to 20 audio scans per day, and limited Deep Scan usage. A free tier with limited daily usage is also available.
These usage caps are part of the Fair Use Policy and keep variable provider costs sustainable. You may not share, resell, or transfer your license. Automated bulk scanning, API key sharing across multiple users, or attempts to bypass usage controls may result in license revocation without refund.
9. Payments and Refunds
Payments are processed securely by Polar. By purchasing a license, you agree to Polar's terms and privacy policy. Refunds are handled according to Polar's refund policy. For issues, contact support at the address below.
10. Governing Law
These Terms are governed by the laws of Italy. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Italy.
